Terms of Service

1. Acceptance of Terms

By accessing or using EventPup ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.

You represent and warrant that you are of legal age to form a binding contract and meet all eligibility requirements. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

2. Description of Service

EventPup is an event planning platform that allows you to:

  • Create and manage events with multiple statuses (draft, live, closed, cancelled)
  • Send invitations via email; optional SMS add‑on in supported regions (billed separately)
  • Coordinate event logistics through our addon system (potluck coordination, ride sharing, guest counts, custom questions, and more)
  • Manage RSVPs and attendee communication, including public RSVP links
  • Organize contacts and profiles (organizations) with tagging and filtering
  • Enable event messaging/chat between organizers and attendees
  • Upload and manage images for events, contacts, and profiles
  • Reschedule, relocate, or cancel events with automatic attendee notifications

Our core principle: Your guests never need to create accounts to participate in your events.

3. User Accounts

Account Creation

  • You must provide accurate, current, and complete information
  • You are responsible for maintaining account security
  • You must be at least 13 years old to create an account
  • If you are under 18 years of age, you represent that you have obtained parental or guardian consent to use the Service
  • If you are 18 years of age or older, you represent and warrant that you meet all requirements of being an adult in your jurisdiction and have the legal capacity to enter into binding agreements
  • One person or entity per account

Account Responsibilities

  • Keep your password secure and confidential
  • Notify us immediately of any unauthorized access
  • You are responsible for all activities under your account
  • Do not share account credentials

4. Acceptable Use

You May:

  • Use the Service for lawful event planning purposes
  • Invite people to legitimate events who have consented to be contacted
  • Share event information with appropriate attendees
  • Organize coordination activities related to your events through addons
  • Use public RSVP links for events where appropriate
  • Enable event messaging/chat for attendee communication
  • Upload images and files for events, contacts, and profiles

You May NOT:

  • Use the Service for illegal activities or spam
  • Send unsolicited invitations or marketing messages
  • Impersonate others or provide false information
  • Interfere with or disrupt the Service
  • Attempt to access others' private information or events
  • Use the Service to harass, abuse, or harm others
  • Violate any applicable laws or regulations
  • Upload malicious files, viruses, or inappropriate images
  • Use event messaging/chat for spam, harassment, or illegal purposes
  • Share public RSVP links in ways that violate others' privacy or consent
  • Use addons to collect sensitive information (e.g., credit card numbers, SSN) without proper security measures

5. Subscription Plans and Billing

Subscription Tiers

EventPup offers multiple subscription tiers with varying features and limits:

  • Free Plan: Personal use with basic features and usage limits
  • Paid Plans: Multiple tiers with enhanced features, higher limits, and additional capabilities

For specific features and limits of each tier, please contact us or check your account settings.

Key Distinctions

Free Plan:

  • Limited to personal use only
  • Email-only invitations
  • Usage limits on events, attendees, and profiles
  • Access to standard addons

Paid Plans:

  • Commercial use permitted
  • Email invitations included; optional SMS add‑on available in supported regions (billed separately; no message credits included)
  • Higher or unlimited limits on events, attendees, and profiles
  • Access to premium addons
  • Additional features vary by tier (multiple profiles, bulk operations, priority support)

Optional SMS Add‑On

If you choose to enable SMS for your events, SMS is provided as an optional add‑on in supported regions and is billed separately from your subscription. Availability may vary by location and plan. Subscriptions do not include message credits.

Billing Terms

  • Paid plans are billed monthly in advance
  • Plans renew automatically each billing cycle
  • You may cancel at any time from your account settings
  • Cancellation stops future billing but does not refund the current period
  • Plan upgrades take effect immediately; downgrades take effect at the next billing cycle
  • Payment is due at the start of each billing period

Usage Limits

  • If you exceed your plan's limits (e.g., events, attendees, profiles), you may be prompted to upgrade
  • Existing events remain functional when limits are reached; some actions may be restricted until within limits or plan is upgraded
  • If you enable the optional SMS add‑on, SMS usage is billed separately and is not included in subscription limits or credits
  • We will notify you when approaching plan limits

6. Content and Data

Your Content

  • You retain ownership of all content you create (events, contacts, messages, images, addon responses)
  • You grant us license to use your content to provide the Service
  • You are responsible for the accuracy of your content
  • You may delete your content at any time
  • Images and files you upload must comply with our file type and size restrictions
  • You are responsible for ensuring you have rights to any images or content you upload

Guest Information

  • You may only invite people who have given consent to be contacted
  • You are responsible for compliance with anti-spam laws (CAN-SPAM, GDPR, and other applicable regulations)
  • We don't create accounts for your guests - they can RSVP and participate without registration
  • Guest data (contact information, RSVP responses, addon responses) is only used for your specific events
  • Public RSVP links allow anyone with the link to respond to your event; you are responsible for managing who receives these links
  • You are responsible for the accuracy and appropriateness of information collected from guests through addons and RSVPs

Prohibited Content

  • Illegal, harmful, or offensive content
  • Content that violates others' rights
  • Spam, malware, or malicious content
  • Content that violates privacy or confidentiality
  • Harassing, abusive, or discriminatory content in event messages or communications
  • False or misleading event information

7. Privacy and Data Protection

  • Your privacy is governed by our Privacy Policy
  • We implement reasonable security measures
  • Guest information is protected and not shared with third parties except as necessary to provide the Service
  • You control who receives your event invitations
  • Data retention policies apply as outlined in our Privacy Policy
  • Images and files you upload are stored securely and automatically deleted when you delete associated content
  • Short links are generated for SMS delivery and may be tracked for access statistics

8. Intellectual Property

EventPup's Rights

  • The Service and its features are our intellectual property
  • Our trademarks, logos, and brand elements are protected
  • You may not copy, modify, or reverse engineer our Service

Your Rights

  • You retain rights to your original content
  • We don't claim ownership of your events or guest lists
  • You may export your data at any time

9. Third-Party Services

Integrations

  • Google Places API for location services and address autocomplete
  • SMS delivery services (for paid plan subscribers) via Twilio
  • Email delivery services
  • Payment processing services (Stripe)
  • File storage services (local or cloud-based storage)

Third-Party Service Limitations

  • SMS delivery depends on third-party carrier networks and may experience delays or failures
  • Email delivery depends on recipient email providers and may be filtered or blocked
  • Short links redirect to signed URLs and may expire based on event timing
  • We are not responsible for third-party service outages or delivery failures

  • Service availability may depend on third-party providers

10. Event Management and Modifications

Event Statuses

  • Draft: Events in preparation, not yet accepting RSVPs
  • Live: Active events accepting RSVPs and managing attendees
  • Closed: Events that have ended and been finalized
  • Cancelled: Events that have been cancelled by the organizer

Event Modifications

  • You may reschedule events (change date/time); we will automatically notify all attendees and pending invitees
  • You may relocate events (change address); we will automatically notify confirmed attendees
  • You may cancel events; we will automatically notify confirmed attendees
  • You are responsible for ensuring modifications are communicated appropriately
  • We are not responsible for any consequences of event modifications or cancellations

Event Messaging/Chat

  • Event messaging allows organizers and attendees to communicate about events
  • Chat may be enabled or disabled per event at your discretion
  • Only attendees who RSVP "Yes" can participate in event chat
  • You are responsible for moderating event messages and ensuring appropriate communication
  • We reserve the right to remove inappropriate messages or disable chat for events that violate these Terms

11. Service Availability

Uptime

  • We strive for high availability but cannot guarantee 100% uptime
  • Scheduled maintenance will be announced in advance
  • We're not liable for service interruptions

Changes to Service

  • We may modify features with reasonable notice
  • We may discontinue features that are no longer viable
  • Core functionality will be maintained or adequate notice provided

12. Termination

Your Right to Terminate

  • You may delete your account at any time
  • Canceling your subscription stops future billing
  • Account deletion is permanent

Our Right to Terminate

  • We may suspend accounts for Terms violations
  • We may terminate accounts for illegal activities
  • We'll provide notice when possible

Effect of Termination

  • Access to the Service ends immediately
  • Your data will be deleted according to our Privacy Policy
  • Outstanding payments remain due

13. Disclaimers

Service "As Is"

  • The Service is provided without warranties
  • We don't guarantee error-free operation
  • We don't warrant that the Service meets your specific needs

Third-Party Content

  • We're not responsible for guest-generated content (RSVP responses, addon responses, messages)
  • Event information accuracy is your responsibility
  • Third-party links are not our responsibility
  • You are responsible for moderating event messages and communications
  • We reserve the right to remove content that violates these Terms or applicable laws

14. Limitation of Liability

Data Loss and Backup

  • We are not liable for any lost data, including but not limited to:
    • Lost or corrupted event information, contacts, RSVPs, or addon responses
    • Lost or deleted images, files, or uploaded content
    • Data loss due to service interruptions, technical failures, or maintenance
    • Data loss due to account deletion, termination, or suspension
    • Data loss due to third-party service failures or outages
  • You are responsible for backing up your data - we recommend exporting your data regularly
  • We are not responsible for maintaining backups of your content beyond our standard data retention policies
  • Data may be permanently deleted when you delete events, contacts, or accounts

Damages

  • Our liability is limited to the amount you paid us in the last 12 months
  • We're not liable for indirect, incidental, or consequential damages
  • This includes lost profits, data loss, business interruption, or loss of business opportunities
  • We're not liable for any damages resulting from:
    • Service interruptions or unavailability
    • Data loss or corruption
    • Third-party service failures
    • Unauthorized access to your account (except where due to our gross negligence)
    • Errors or omissions in event information or communications

Exceptions

  • Liability limitations don't apply where prohibited by law
  • Intentional misconduct is not limited
  • Death or personal injury caused by negligence is not limited

15. Indemnification

You agree to defend, indemnify, and hold us harmless from claims arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of others' rights
  • Content you submit or share

16. Dispute Resolution
